E. Contracting in the Online Shop

The following information refers to the handling of your data in connection with an order in the online store on our website.

2. Ordering

If you place an order on our website, we will use the data you provide to process the order and fulfil our contractual obligations.

An order is possible either in combination with a registration (see E. 1.) or as a guest (option “direct order”). In the latter case no user account will be registered.

  1. Transfer of Special Order Data to Third Countries

In order to fulfill our contractual obligations it may be necessary, depending on the subject matter of the contract, that we pass on some personal data to subcontractors in countries outside the European Union (EU) or the European Economic Area (EEA).

This is done exclusively on the basis of your explicit consent obtained beforehand for the purpose of executing the order. This only affects the link to your publicly available profile on a social network specified in the order together with information that is absolutely necessary for the execution of the order (depending on the order content, the desired number of likes, fans, plays, views, followers, subscribers). This information may be passed on to subcontractors in one or more of the countries listed below: United States of America (USA), Brazil, India, Russia, China (Hong Kong), Macedonia, Thailand.

We would like to point out that for the states mentioned above, there is neither a decision of the European Commission on an adequate level of data protection nor sufficient guarantees to establish an adequate level of data protection. Accordingly, there is an increased risk that the data mentioned in the section above – and only this data – will be processed in contravention of the basic principles and requirements of data protection law within the European Union and the European Economic Area.

Other or more extensive personal data will not be passed on in this or any other context to countries outside the EU or EEA on the basis of consent obtained from you. With regard to data transfers in other contexts, we refer to Section F. or the explanations in the other sections of this Privacy Policy.

The legal basis for processing this data abroad is your consent, Art. 6 para. 1 lit. a DSGVO. You have the possibility to revoke your consent to the processing of your data at any time. To do so, please use the above-mentioned contact options. In the event of a revocation, all your personal data transmitted for this purpose will be deleted.

5. Use of Email Address for the Purpose of Direct Advertising

If a contract is concluded via our online store, we use the email address you provide in connection with the order to send you electronic direct mail.

Technically, the electronic transmission of advertising is carried out in accordance with the explanations in this privacy policy in section “I. NEWSLETTER”.

Notwithstanding section “I. NEWSLETTER”, the processing of data in this context is for the purpose of advertising our products to relevant existing customers (those who have already purchased similar products from us). Our legitimate interest here is the execution of our business activities and the processing is based on Art. 6 para. 1 lit. f DSGVO, § 7 para. 3 UWG.

You may object to this data processing at any time (see section “J. RIGHT OF OBJECTION”). In addition, every email from our direct marketing department contains a link to exercise your right of objection.

F. Processing in Third Countries in General

Unless otherwise stated above, your personal data will be processed in countries outside the European Union (EU) or the European Economic Area (EEA) exclusively on the basis of the legal requirements pursuant to Art. 44 DSGVO. This is exclusively the case either on the basis of an adequacy decision of the European Commission (Art. 45 DSGVO) and/or on the basis of appropriate guarantees (Art. 46 DSGVO).

G. General Storage Time

In general, personal data is stored exclusively for as long as it is necessary to fulfill the purpose of data collection or to comply with the respective legal retention period. After the purpose has ceased to apply or the period has expired, the data will be deleted.

H. Rights of Data Subjects

As far as we have processed your personal data, you are a data subject in terms of the DSGVO and you have the following rights against us:

Art. 15 DSGVO – You may request information about your personal data processed by us. In particular, you may request information on the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, cancellation, restriction of processing or opposition, the existence of a right of appeal, the origin of your data, if not collected by us, as well as the existence of automated decision making including profiling and, if applicable, meaningful information on the details of the data.

Art. 16 DSGVO – You can immediately request the correction of incorrect or incomplete personal data stored by us.

Art. 17 DSGVO – You can request the deletion of your personal data stored with us, unless processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.

Art. 18 DSGVO – You can demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, if the processing is unlawful but you refuse to delete it and we no longer need the data, but you need it for the assertion, exercise or defence of legal claims or if you have lodged an objection to the processing pursuant to Art. 21 DSGVO.

Art. 20 DSGVO – You may receive the personal data you have provided in a structured, common and machine-readable format or request that it be transferred to another responsible party.

Art. 7 para. 3 DSGVO – You can revoke your consent once given to us at any time. As a result, we may no longer continue the data processing based on this consent for the future.

Art. 77 DSGVO – You can complain to a supervisory authority. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our registered office.

I. NEWSLETTER

We offer a newsletter service in which we inform the recipients about our services (newsletter subscription). To receive this newsletter, you must register for it on our site. The data entered by you during the registration process will be transmitted to us and will only be used to send the newsletter.

This involves:

  • (1) The e-mail address you provided
  • (2) The IP address of the computer system you are using
  • (3) Date and time of registration

We need your email address to send you the newsletter. The remaining information is required to prevent misuse of our e-mail address and the e-mail address you have provided.

The voluntary details enable us to provide you with more targeted information about our services. However, this information is not required for sending the newsletter.

For shipping we use “MailChimp”, a service of the Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The above mentioned data will be transferred to this company as part of the order processing according to art. 28 para. 3 p. 1 DSGVO, i.e. the company will not use this data to contact you directly or to pass the data on to third parties.

When using services of Rocket Science Group, LLC, data transfer takes place to countries outside the European Union or the European Economic Area. An adequate level of data protection is guaranteed by the use of standard contractual clauses of the EU Commission in the sense of Art. 46 para. 2 lit. c) DSGVO.

We analyze the reading behavior of our newsletter mailings and can calculate the opening rate and click rate. We are able to attribute this behavior to individual newsletter recipients. This is done with the purpose of making our newsletter even more interesting and adapt it to the needs of our interested parties.

Before sending your registration to receive our newsletter, your consent will be obtained and reference will be made to this data protection declaration (Art. 6 para. 1 lit. a DSGVO).

A termination of the subscription and thus an objection and removal possibility of the data processing is possible at any time. For this purpose, each email of our newsletter contains a corresponding link for cancellation.

J. Right of Objection
